These Terms and Conditions ("Terms") constitute a legal agreement between you ("User," "you," or "your") and SIW s.r.o. ("we," "us," or "our") regarding your use of the Nicco mobile application and website at www.trynicco.com (collectively, the "Service").

By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

About Our Service

Nicco is a quit smoking assistance application that provides:

  • Smoke-free timer and progress tracking
  • Cravings and habit tracking
  • Money saved calculator
  • Health improvement milestones
  • Reminders and motivational notifications
  • Streaks and achievement tracking

Eligibility and Age Requirements

  • You must be at least 18 years old to use our Service
  • If you are under 18, you may only use the Service with parental consent and supervision
  • You must provide accurate and complete information when creating your account
  • You are responsible for maintaining the security of your account credentials

Subscription and Payment Terms

Current Status

Nicco currently operates as a free service. When premium subscriptions become available:

Future Premium Features

  • Subscriptions will be processed through app stores (Apple App Store, Google Play Store)
  • Subscription fees are charged according to your selected plan
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Free trials, if offered, will convert to paid subscriptions unless cancelled
  • You can cancel subscriptions through your app store account settings

Refunds

Refund policies will follow app store guidelines and applicable consumer protection laws.

Intellectual Property Rights

Our Rights

  • We own all rights to the Nicco application, including software, design, content, and trademarks
  • You are granted a limited, non-exclusive, non-transferable license to use our Service
  • This license terminates when your use of the Service ends

Your Content

  • You retain ownership of any personal data you input into our Service
  • By using our Service, you grant us the right to process your data as described in our Privacy Policy
  • You are responsible for the accuracy of information you provide

Privacy and Data Protection

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE LAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR ANY HEALTH OUTCOMES OR DECISIONS MADE BASED ON OUR SERVICE

Nothing in these Terms excludes or limits our liability for death, personal injury, fraud, or other matters where limitation is prohibited by law.

Indemnification

You agree to defend, indemnify, and hold harmless SIW s.r.o., its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

Termination

By You

  • You may stop using our Service at any time
  • You may delete your account through the app settings
  • Cancelling subscriptions (when available) must be done through your app store

By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Use the Service inappropriately
  • Engage in fraudulent or illegal activities
  • For any reason with reasonable notice

Upon termination, your right to use the Service ceases immediately.

Changes to Terms

We may update these Terms from time to time to reflect:

  • Legal or regulatory requirements
  • Business practice improvements

We will notify you of significant changes through:

  • In-app notification
  • Website posting

Your continued use after changes constitutes acceptance of the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of Slovakia and the European Union, without regard to conflict of law principles.

Dispute Resolution

  • We encourage resolving disputes through direct communication first
  • For EU residents: You may use the European Commission's Online Dispute Resolution platform
  • Legal disputes shall be resolved in the courts of Dolný Kubín, Slovakia
  • You retain rights under applicable consumer protection laws

Miscellaneous

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SIW s.r.o.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not transfer your rights under these Terms. We may assign our rights to any affiliate or successor.
